PRIVACY POLICY
Effective Date: Sep 20, 2026.
Last Updated: Sep 20, 2026.
This Privacy Policy explains what personal information Houston Cartworks LLC (“we,” “us”) collects when you visit www.houstoncartworks.com, make a reservation, sign our agreements, or rent a golf cart, and how we use, share, protect, and retain it. It applies to our website, booking tools, e-signature flows, text and email messages, and the carts themselves.
1. Information We Collect
- Identity and contact information. Name, email, phone, mailing and delivery address, and emergency contact. We collect this from you.
- Eligibility and verification information. Date of birth, driver’s license number, issuing state, and a photo or image of the license. We collect this from you and from our staff at delivery.
- Rider and guest information. Names, dates of birth and signatures of Authorized Drivers and adult riders. For minor riders, we collect the minor’s name and date of birth from a parent or guardian, not from the minor.
- Payment information. Card type, last four digits, billing ZIP and transaction records. Full card numbers are handled by our payment processor, Stripe, and are not stored on our systems.
- Agreements and signature records. Signed agreements, initials, consent checkbox records, IP address, device and browser details, and time stamps.
- Rental records. Quotes, booking history, delivery and pickup checklists, inspection photos and videos, incident reports, damage invoices and correspondence.
- Vehicle location and telematics data. GPS location, movement, speed and battery data from the cart while it is rented.
- Website and device data. IP address, browser, device type, pages viewed, referring page, approximate location, cookie identifiers and clicks.
- Communications. Emails, texts, call records, messages, reviews and your marketing preferences.
2. How We Use It
We use personal information to:
- verify your age, identity and license and decide whether we can rent to you;
- take bookings and payments, deliver and pick up carts, and manage deposits, fees and refunds;
- prepare, present and store signed agreements and prove acceptance, including for disputes;
- document the cart’s condition and investigate damage, theft, incidents and claims;
- locate carts, protect them from theft and enforce our rules;
- communicate with you about your rental, including delivery updates, invoices and safety notices;
- send marketing messages only if you have opted in;
- detect and prevent fraud and misuse, secure our systems, and improve the website and services;
- obtain insurance and comply with law, court orders and legal rights.
We do not use driver’s license information for any purpose other than verifying identity, age and eligibility, preventing fraud, and documenting the rental.
3. Sensitive Information
Some information we handle is sensitive, including driver’s license numbers and images, precise geolocation from cart trackers, and information about minors. We collect only what we need, limit access to staff who need it, and do not sell it. We do not collect biometric identifiers, such as facial-recognition templates or fingerprints, and we do not use license-scanning technology that reads the barcode or magnetic stripe on a license except as Texas law allows.
4. How We Share It
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only as follows:
- Service providers that help us run the business under contract, such as payment processing, booking and scheduling, e-signature, cloud storage, email and text messaging, website hosting, analytics, customer support, accounting and fraud prevention.
- Insurers, attorneys, accountants and professional advisers as needed to obtain coverage, handle claims and obtain advice.
- Law enforcement and authorities when we believe disclosure is required by law or needed to report theft, protect safety, or respond to legal process.
- Other parties to a claim (such as an injured person or their insurer) to the extent reasonably needed to handle an incident.
- Business transfers. If we merge, sell assets or reorganize, information may transfer to the successor. Information transferred in connection with a merger, acquisition, financing, restructuring, or sale of assets will remain subject to applicable contractual and legal obligations.
5. Vehicle Tracking and Location Data
Carts may carry GPS trackers. We collect and access location data during the rental period and when necessary to investigate theft, loss, damage, insurance claims, or legal disputes. We access location data to locate the cart, confirm it remains at the authorized delivery location, investigate theft, damage, accidents, and rule violations, and provide information to law enforcement, insurers, or legal authorities when reasonably necessary.
We do not use it to track your personal movements for any other purpose. We keep it for 90 days after the rental unless needed for a dispute, claim, or investigation. The Rental Agreement tells you about the tracker, and you must tell other drivers and riders.
6. Cookies, Analytics and Similar Technologies
Our website uses:
- Essential cookies that make the site work (booking session, checkout, security, fraud prevention).
- Analytics cookies such as Google Analytics that tell us how visitors use the site so we can improve it.
You can control cookies through your browser settings. We will treat a browser’s Global Privacy Control signal as an opt-out where applicable. Blocking cookies may break the booking process. We do not respond to Do Not Track signals because no uniform standard exists.
7. Payments
Payments are processed by Stripe, a PCI DSS-compliant provider. We receive confirmation of payment, card brand, last four digits and billing ZIP, but not your full card number. Their use of your data is governed by their own privacy policy available at: https://stripe.com/privacy.
8. Email and Text Messages
By giving us your phone number or email, you agree we may send transactional messages about your inquiry, booking, delivery, safety, invoices and inspections, by email, call or text. Message and data rates may apply, and you can reply STOP to opt out of texts, although we may still need to email or call about an active rental.
9. Children and Minors
Our website is not directed to children, and you must be at least 18 to use it to book. We do not knowingly collect personal information online from children under 13. If we become aware that we have collected personal information directly from a child under 13 without verifiable parental consent, we will delete such information as required by applicable law.
We collect a minor rider’s name and date of birth from a parent or guardian for safety and legal purposes. A parent or guardian may ask us to access or delete that information, subject to our legal retention needs.
10. Retention
- Signed agreements, exhibits, acceptance logs, delivery and pickup checklists and photos: 7 years after the rental ends.
- Minor rider acknowledgments: Until at least 2 years after the minor turns 18.
- Driver’s license images: 90 days after the rental ends and deposit resolution.
- Payment and tax records: Generally 4 to 7 years.
- GPS and telematics data: 90 days unless an incident or claim is open.
- Website analytics: 24–36 months.
- Marketing list: Until you unsubscribe.
We delete or de-identify information when no longer needed and suspend deletion when we are on notice of a claim or legal hold.
11. Security and Breach Notice
We use reasonable administrative, technical and physical safeguards, including access controls, encryption in transit, and limiting stored license and payment data. No method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
12. Your Choices and Privacy Rights
Whether or not a privacy statute requires it, we give every customer these rights, free of charge, by emailing info@houstoncartworks.com with “Privacy Request” in the subject line:
- Access the personal information we hold about you and receive a copy.
- Correct inaccurate information.
- Delete your information, subject to legal retention requirements.

We will verify your identity and respond within 45 days and may extend once by 45 additional days if needed.

13. Third-Party Links and Services
Our website may link to or embed third-party services (payment, maps, social media, e-signature). We do not control their privacy practices. Review their policies before sharing information.
14. International Visitors
We operate in the United States and generally store and process information in the United States through ourselves and our service providers.
